1. About This Website

This website provides general information about landscaping and property services offered by AJ's Lawncare & Property Services LLC ("AJ's Lawncare," "we," "us," or "our") in the Dallas–Fort Worth area. You must be at least 18 years old or have the involvement of a parent or legal guardian to request or purchase services.

2. Website Information Is Not a Service Agreement

Website descriptions, photos, calculators, examples, starting prices, availability, and other content are for general information only. They are not a binding quote, guarantee, or promise that a particular service, material, schedule, or price is available.

Landscaping work is governed by the written estimate, proposal, invoice, work order, or service agreement accepted for that project. If a project document conflicts with these website Terms, the project document controls for that project.

3. Estimates, Measurements, and Calculators

Website calculators and material guides provide planning estimates only. Actual quantities, labor, pricing, and project requirements may change based on field measurements, grading, access, soil conditions, drainage, utilities, material density, supplier packaging, waste, site conditions, and other factors discovered during an on-site review or the work.

A request submitted through the website does not create a contract or reserve a project date. A project begins only after both parties accept the applicable project terms and any required deposit or payment is received.

4. Calls, Texts, and Electronic Communications

AJ's Lawncare SMS Program. When you call, text, email, submit an estimate request, or otherwise provide your mobile number and consent to receive text messages, you authorize AJ's Lawncare to communicate with you about your request and any resulting customer relationship. Messages may include estimate and quote follow-ups, appointment confirmations and reminders, scheduling notices, project and service updates, invoice or payment reminders, customer-support messages, and promotional offers.

Message frequency varies. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchasing services. Reply STOP to opt out of text messages or HELP for help. You may also call or text us at (972) 363-3963 for assistance. Carriers are not liable for delayed or undelivered messages.

You are responsible for providing accurate contact and project information. Electronic communications may not be secure, so please do not send Social Security numbers, full payment-card numbers, account passwords, or other highly sensitive information by ordinary text or email.

5. Acceptable Use

You agree not to:

Use the website for unlawful, fraudulent, abusive, or misleading purposes;

Interfere with the website's operation, security, or availability;

Attempt to gain unauthorized access to the website, accounts, systems, or data;

Introduce malicious code, scrape the website in an abusive manner, or overload its infrastructure; or

Impersonate another person or submit information you do not have the right to provide.

6. Photos, Messages, and Other Submissions

You retain ownership of photos, messages, plans, and other content you send us. You grant us a limited, nonexclusive license to use that content to evaluate your request, prepare an estimate, communicate with you, perform agreed services, maintain business records, and protect legal rights. We will not use identifiable project photos in advertising without permission or another lawful basis.

You represent that you have the right to provide submitted content and that our permitted use of it will not violate another person's rights.

7. Intellectual Property

The website's design, text, branding, logos, graphics, arrangement, and original content are owned by or licensed to AJ's Lawncare and are protected by applicable intellectual-property laws. You may view and print website content for personal, noncommercial use, but you may not copy, reproduce, modify, publish, sell, or commercially exploit it without prior written permission.

8. Third-Party Websites and Services

The website may link to third-party websites or services. Those links are provided for convenience and do not mean we control or endorse every third-party statement, product, service, policy, or practice. Your use of a third-party service is governed by that provider's terms and privacy policy.

9. Website Availability and Disclaimers

We work to keep the website useful and accurate, but we do not promise that it will always be available, uninterrupted, error-free, secure, or current. To the fullest extent permitted by law, the website and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied.

Nothing in these Terms excludes a warranty, remedy, or right that cannot lawfully be excluded. Project-specific workmanship or material warranties, if any, are stated in the applicable project documents.

10. Limitation of Liability

To the fullest extent permitted by law, AJ's Lawncare and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the website or reliance on general website content.

Our total liability for a claim arising solely from use of the website will not exceed the greater of $100 or the amount you paid us, if any, specifically for access to the website during the twelve months before the claim. This limitation does not apply where prohibited by law and does not replace the liability terms of an accepted project agreement.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless AJ's Lawncare and its owners, employees, contractors, and representatives from claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the website, your violation of these Terms, or content you submit without the necessary rights.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise or a project agreement provides otherwise, any legal action arising solely from these Terms or the website must be brought in a state or federal court with jurisdiction in Dallas County, Texas.

13. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page and changing the "Last updated" date. Changes apply prospectively when posted. Your continued use of the website after an update means you accept the revised Terms.

14. Severability and No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of our right to enforce it later.
